I heard from the bbb today and got paypals response to it.  They offered me half  of my money back.  Now if that isn't addmitting they were wrong what is?  They stated they wasn't able to credit it to my paypal account because I had closed it and needed to contact them.  My reply to the bbb was I declined their offer and want all my funds!!  That I only want what belongs to me and nothing more or less.  I copy and post it here but it is pretty long.  So bbb does at least look into complaints.  Now I have more to add to the information I am mailing to the Ca. AG.  The more complaints the sooner ebay/paypal will start looking at the way they conduct business.  I try to slam paypal on their board as much as possible and will continue.  Nice to be retired with all this free time

I sent this letter to PP thru the complaint process & got a response with in a bout 4 hours


PayPal has made an unauthorized electronic funds transfer by withholding my funds as outlined in clause F(iii). I Request a copy of all documentation paypal used in determining to freeze my account. EFTA requires paypal to investigate my claim within a short time period, provide a "meaningful" response, and actually send me any paperwork it has to support its action, at my request, this is in case I have no recourse but to sue PayPal for triple damages as allowed under the Act. I have also been in contact with all necessary Attn. Generals, BBB & local authorities. I will pursue this to no end no matter what the cost is to me…this is a matter of principal!!

This is the response they gave me,


Thank you for contacting PayPal, my name is Michelle and I am with
PayPal's Executive Escalations.  I sincerely apologize for the
frustration this matter has caused. I have reviewed your account and
would like to offer the following information in response to your
inquiry.

A review of your account, under the email address npsales.com@gmail.com,
shows that on March 4, 2006, your account was placed under limited
access as you were linked to an account under the email address
bob808bob@msn.com . The accounts share last name, login location,
address and merchandise.  PayPal felt that this was enough information
to warrant further examination.

In accordance with our User Agreement, PayPal may place a hold on funds
in your account, limit funding sources and payments, limit access to an
account and any or all of the account's functions (including but not
limited to the ability to send money or making withdrawals from an the
account), limit withdrawals, indefinitely suspend or close your account
and refuse to provide our Services.

Furthermore, PayPal may "continue to limit your account access for up to
180 days as is necessary to protect PayPal against the risk of
reversals, or may close your account by giving you notice and mailing a
check for any funds in your account (minus funds that are in dispute) to
the address that you have provided."  In the event that a chargeback or
Buyer Complaint is received against your account during the 180-day
timeframe, and you do not qualify for the Seller Protection Policy, your
PayPal balance will be debited for the amount of the chargeback or
complaint.

Based on the information we have, we have determined that the risk of
offering you our services exceeds the risk that we are willing to
accept.   Consequently, your account was placed under limited access.
Now you can restore access to your account by taking the steps provided
to you in your account and having the operator of the aforementioned
account contact PayPal and take the steps necessary to restore full
access to the account.

I am very sorry that you feel it's necessary to escalate this issue to
your state's Attorney General, Better Business Bureau and your local
authorities. Generally, these agencies forward your inquiry to us for
review and we are able to respond to your complaint within a few days.
Should you find it necessary to escalate your concerns to the
aforementioned agencies, we will be happy to respond to the inquiry we
receive.

Again Mr. X, I sincerely apologize for any inconvenience this
situation has caused.  Please feel free to contact me directly at

#1 That is B.S. No one has lived at this address for over 2 years &....


#2 I started the account when I moved in. I did have an old PP account but it was never used at or from this address & was not registered to this address....


#3 The items I sell always change & are different from month to month or even week to week.


#4 That leaves us with the same last name & that is the only real proof they have & they are making their decision on that one fact alone. Every other reason they gave is 100% B.S!


#5 My question is thru what eBay account, notice they are not claiming to tie my PP account to my eBay account??? I am confused?


Oh ya they did not pick up on cookies or anything because I completely reformatted & restored my PC when I moved in here so it was clean as a whistle.

Can you just imagine what they would do if you froze their funds?  Sorry this happen to you and someone has got to do something to stop this kind of crap.  I would sure like to run into Arnold on a motorcycle run and I would sure burn his ears about Paypal.  Is it really legal to swindle and steal and fraud like this in the state of California?  Maybe we should all try to find a drop point a person in California to mail our complaints about paypal to c/o calif Gov and have them collected and delivered to Arnold in person for us.  I think we could fill his office to the ceiling.  A thought but then big things happen that way.

are they kidding?   how are you supposed to go about find the guy who owns this email account?  why don't they just email him and ask him themselves???  that is ridiculous.   how do you even found out what this guys name is?   will they give you that information?   i would email them back and tell them since they froze your account based on a guy that you don't even know that they should give you his complete contact information so that you can call him and tell the m-fer to close his paypal account and make him call paypal and tell them that he is not you.

I think they would just rather have my $1800 than do any real work. Little do they know I did get $1150 worth of my merchandise back & had those buyers file claims to get their money back from PayPal. I am very tempted to contact every buyer in the past 3 months "that spent any sort of bigger amount with me" & tell them to file a claim with PP. I bet I could get my account into the negative real fast. How would they like that (+) $1800 to (-) $700 or more, that sounds good to me.


I think they would quit freezing accounts if everyone did this because then they would only lose by freezing accounts. I personally would rather the buyer get an item for free than to see PP 100% profiting off my goods. Everyone with a frozen account needs to have their buyers file claims & get their money back, if they are good people they will send you the payment in a different form but if they don't then at least PP will not have 100% profited from it.


Think just 10,000 frozen accounts @ say $1,000.00 each = $100,000.00 now instead of PP being ahead the 100K how would they like it turning into a negative (-) $35,000.00 or more. That is a huge swing so this is my best idea on what to do to actually hit them in the pocket book. Again I only figured that at 10,000 accounts & I know there are a lot more than that frozen by PP at any given moment, probably more like 100,000+ accounts frozen which would actually = $350,000.00+ they stand to loose if people (buyers) just file claims & get their money back. If everyone with a frozen account did this I believe PP would be in big trouble & they would start freezing other legitimate accounts with big money in them to recuperate the losses & by doing so they will piss even more people off thus digging a bigger hole for themselves to climb out of.

Too bad the BBB does not have any real power to enforce anything. All they can do is to record the complaint and whether or not it was corrected. They are not a govt agency whatso ever. They can do absolutely nothing to help.

It is still worth com[plaining, just dont expect much out of it.

The real places to complain are at the FTC, your state AGs office, the Nebraska and Ca AGs, your legislators, by all means, do not overlook the media. Sooner or later this fraud needs to be exposed to everyone.

I know and that is why I have all this documentation so I can send it to all of these agencies and the one from the bbb just shows they tried to buy me off and admitted they were wrong so along with that and the copy of the listing and the verification the item was fraud from a major company stateing their trade mark was even fraudulently used.  I am just waiting for one more peice of the documentation.  Their claim of a invalid tracking number.  Which they are full of you know what. 


I can see your point Bud in rather seeing anyone have the paypal funds over them stealing them.
