Law360, San Francisco (April 24, 2013, 7:49 PM ET) -- PayPal Inc. urged a California federal judge Wednesday to toss a putative class action accusing the site of illegally sending users unsolicited text messages, arguing that the users consented to receiving auto-dialed or prerecorded calls by voluntarily providing PayPal with their cellphone numbers.

If everyone recalls, there was NO opt out for the telemarketing portion of the user agreement. (either for ebay or paypal) Furthermore the address people were supposed to send the opt outs to was a residential address on Shady Lane or some such , which seemed to show as foreclosed, yet was represented to be some sort of world headquarters for a bazillion mysterious entities...
oops maybe that was ebay only. PP's opt out might have been to be sent to it's real addrsss.. not sure ...
